QURLI’S PRIVACY POLICY

This privacy policy (“Privacy Policy”) applies to the use of the website https://qurli.app/ in its entirety, including all of our subpages, associated sites or pages (“Website”), and the QURLI app, which is accessible through your mobile phone and tablet computer (“App”, “QURLI”), are operated by Online Classifieds AG, Baarerstrasse 8, 6300 Zug, Switzerland, CHE-274.401.166 (“we”, “us”, “our”).

We are responsible for all information relating to an identified or identifiable natural and, where applicable, legal person (“Personal Data”) that we collect, process, and use during your use of QURLI. 

This Privacy Policy outlines how we process your Personal Data both in connection with QURLI and otherwise.

1. Privacy-first approach

We are committed to protecting your privacy and handling your Personal Data in accordance with applicable laws and regulations. To achieve this, we adhere to the principles of data minimization and purpose limitation. We will only collect and process personal information that is necessary for the specific purposes stated in this policy. Your data will not be used for any purpose other than those disclosed and we will only retain it for as long as required to fulfill these purposes or requests under applicable law.

We also prioritize transparency and respect for your privacy choices. You have the right to access, correct, or delete your personal data held by us. Your privacy is important to us, and we are committed to maintaining the highest standards of data protection and user control in order to make QURLI a service that people love and trust.

2. What Personal Data do we collect?

Some of the personal data we collect is mandatory for the provision and functioning of QURLI, while other personal data is considered optional, designed to enhance your user experience. Please be aware that without providing the mandatory personal data, we won't be able to grant you access to QURLI.

a. When visiting the App

When you visit the App, we can process the following categories of Personal Data from you:

  • Technical Data: IP address, operating system, date and time of access, country from which QURLI is accessed (based on IP address), referrer URL, log-in data, and device type;
  • Tracking Data: See Article 6 below.
b. When creating an account 

When you create your QURLI account, you voluntarily provide us with certain information. In this way, we can process the following categories of your Personal Data, which are either mandatory or optional for creating account and using QURLI:

  • Gender (man, woman or non-binary);
  • Sexual orientation (heterosexual, bisexual, lesbian, gay, queer or asexual);
  • Date of birth;

Profile data:

  • Account data, including User ID.

Optional:

Contact data:

  • Email address;

Profile data:

  • Identity data, details about your ad (personal description, height, spoken languages);
  • Sexual and other preferences (turn-ons).
c. When using QURLI

When you use QURLI, you voluntarily provide us with certain information. When you add information to your user profile, interact with us or other users, you make the choice to share your certain personal information with us. In this way, we can process the following categories of your Personal Data, some of which are optional, while others are mandatory to enable you to use QURLI to its fullest potential and enhance your overall experience:

 Optional:

  • Location data, including geographical position, time identifier;

QURLI is designed to help you engage with other users located nearby to you. We use your location data (e.g., by using the GPS on your mobile device) to enable the intended functionality of QURLI. This will be enabled only if you explicitly give us permission to access your location. You can disable this at any given time by changing the location permissions on your device. Please keep in mind that when you use QURLI, other users can view your location data and they may use it for purposes you did not intend, or disclose it to individuals or entities outside of our control and without our and your knowledge. The information you provide may be subject to abuse, misuse, and monitoring by others, and you share this information at your own risk.

  • Transactional data, including information about the application process, contract content, contract management and execution;
  • Financial data, including billing and payment information;
  • Usage data, being User’s content and material which has been submitted by Users as “Personal ads and Profile”, including pictures, as well as content and material which has been submitted in the chat conversations, including videos, audio, pictures, and text messages sent when communicating with others (collectively, “User Submissions”) are processed in order to secure and operate services and keep our user community safe. To protect our users and our platform, and to comply with applicable law, including child-safety and online-safety obligations that may apply in certain jurisdictions, we may use a combination of manual moderation and automated systems to detect, review, and address unlawful or prohibited content and conduct on QURLI, including fraud, scams, exploitation, and child sexual abuse material (“CSAM”). This may include the review of Personal ads and content shared in chat conversations, including pictures, videos and text. For certain safety functions, including CSAM detection, the content itself and/or derived data such as hashes, results, scores, or related technical indicators may be transmitted to specialised service providers for processing. Where required by applicable law, or where potential CSAM or serious child-safety risks are identified, relevant data may be reported to the appropriate authorities. Where our systems identify potential CSAM or other serious safety risks, the content may be subject to additional analysis and review by our trained human moderators. Where relevant, flagged content may lead to further review and enforcement action in accordance with our Terms and Conditions (here).
  • Usage data, being pictures and videos that you upload, publish or provide in any other way. In order to add this kind of content, you first have to give us permission to access your photo album/gallery and/or your camera. You can revoke photo and camera access at any time through your device’s Settings menu;
  • Information about the images (e.g. metadata), such as the location of a photo and device information. If users choose to share images on QURLI and use them in their ads, they also consent to the sharing of metadata related to those images. This serves as a tool for the moderation process, aimed at preventing potential scams and other fraudulent activities. In our commitment to prioritizing users’ privacy, the collected location data is approximate and generalized rather than precise. It is important to note that this data is used solely for moderation purposes and is treated with the utmost confidentiality and security.
  • Usage data, including activity data, online interactions with us and with other users; as well as technical and interaction data collected through analytics (see Article 6 below) that help us understand how QURLI is used, improve functionality, and resolve technical issues;
  • Sexual identity data, including sexual orientation and other sexual preferences (turn-ons and types of connections you prefer);
  • Marketing and communications data, including your marketing preferences, your insights into our products and services, responses and testimonials your provide us when you participate in surveys, market studies or answering questions;
  • Marketing and communications data, including information that is used for participation in different contests, events and promotions we provide;
  • If you contact our customer support team, we collect the information you give us during the interaction,
  • Identity data, being a photographic image of you and/or your form of identification to confirm your date of birth when appealing our decision to revoke your license, authorization to access and/or use QURLI, and terminate your account for failure to comply with our minimum age requirements, or to verify the authenticity of your profile in the event of a suspected breach of our Terms and Conditions (here).
  • Biometric data, you have an option to voluntarily complete a profile Photo verification process to earn a Verification badge. The provided in-app feature allows us to confirm a match between the captured photos during the process and the ones you’ve uploaded to your profile on QURLI.
    Photos captured during the Photo verification process are stored on our servers and are used only for the core functionality of this feature. These photos are then compared exclusively on the server side to confirm a match. We do not and will not use collected biometric data to personally identify users. All biometric data collected during the comparison process will be securely stored on our servers, will not be shared with any third parties, and will be handled in strict accordance with our privacy and data protection standards. Even if the process was not successful, biometric data will be retained in our systems in accordance with Article 11 below for as long as necessary to fulfill the purposes described in this subsection.
    The Verification badge, if awarded, is for informational purposes only and may be automatically removed if you change or remove the submitted picture, or if the face does not match during a subsequent check. You can remove your Verification badge by deleting your account. Upon account deletion, any biometric data collected during the process, as described above, will also be permanently deleted. If you choose to cancel the Photo verification process at any point before its completion, no biometric data related to this process will be retained. d. Age Verification

To enforce our minimum age requirements, protect minors, and safeguard the safety and integrity of QURLI, we may require certain users to complete an Age Verification process before they can access or continue using certain features of QURLI. This may apply where age verification is required by applicable law, where age-estimation or age-verification tools form part of the access flow in a particular jurisdiction, and/or where our systems or human moderators identify indicators of a potential breach of our Terms and Conditions or applicable guidelines, including but limited to suspected underage users or fake accounts. Where Age Verification is required, it is typically carried out through an automated step-by-step process provided by our third-party partner Veriff and may involve the submission of a government-issued identity document and a face scan or liveness photo to confirm eligibility. After the Age Verification process, Veriff provides QURLI with the verification outcome in the form of a pass-or-fail result, together with limited related information made available to QURLI in connection with the verification. This may include certain data points generated or extracted during the verification process, such as gender, estimated gender, estimated age, and the user’s date of birth. QURLI uses the pass-or-fail result only to decide whether the user may access or continue using QURLI and, where appropriate, whether account restrictions or enforcement action should be applied for failure to satisfy age verification requirements or for breach of our Terms and Conditions. Veriff’s verification flow may involve automated analysis of the submitted information and related verification checks, including the processing of photos or video of the verification session, face scans and other measurements, and a comparison with submitted documents. QURLI does not receive the source images, face snapshots, biometric templates, or other underlying biometric data processed by Veriff. To initiate the verification flow, we share with Veriff only an internal unique identifier assigned to the User.

Veriff collects, processes, and stores the underlying verification data on its side. According to Veriff’s current retention framework, session data used for identity verification may be retained for 7 days in active storage and then for up to 3 months in secure archive, subject to Veriff’s applicable retention settings and policies. Veriff may also process certain verification data, which may include biometric or other data generated during the verification flow, for its own purposes, including fraud prevention, service development and improvement, and machine learning training or related purposes, where it acts in its own capacity and on its own legal basis. QURLI retains the verification result and related review or appeal data only for as long as necessary for account management, compliance, and dispute-resolution purposes, unless a longer retention period is required by law or is necessary for the establishment, exercise, or defence of legal claims.

If the automated procedure cannot be completed for any reason (for example, if the service is unavailable), we may invite you to undergo a manual review of your government-issued document by one of QURLI’s trained human moderators. Veriff is not involved in this fallback process, which happens on QURLI’s side and outcome is stored exclusively on QURLI’s systems. Any personal data processed by QURLI in connection with such manual review will be retained only for as long as strictly necessary for the verification, review, appeal, compliance, or dispute-resolution purpose for which it was collected, and then deleted in accordance with this Privacy Policy. Users have also the right to request human review and contest a verification-related decision.

3. How do we collect your Personal Data?

We receive most of your Personal Data directly from you, for example when you interact with us by email, create an account, subscribe to QURLI, update your marketing preferences or provide us with feedback. We collect certain technical data and tracking data when you interact with our App, through tracking technologies, analytics and log files. For more information, please see Article 6 of this Privacy Policy. To the extent permitted by applicable law, we can also obtain your Personal Data from publicly available sources or from public authorities and other third parties (e.g., service partners, internet analysis services). Personal data we share with third parties is regulated by Article 8 of this Privacy Policy. 

4. How do we use your Personal Data?

We use your Personal Data to provide you products, offer you services, communicate with you, or to conduct other business operations, such as using data to improve and personalize your experience. Examples of how we may use the personal data we collect include:

  • Business relationships: We utilize transactional data, financial data, User Submissions and others for establishing, administrating, and processing contractual relationships, including the creation and management of a user account to enable you to fully utilize QURLI.
  • Ensuring the core functionality of the business and QURLI: We use location data, including geographical position, time identifier, identity data, sexual identity data, including sexual orientation, sexual preferences and others to ensure the core functionality of the business and QURLI, which encompasses maintenance, provision, improvement, monitoring, and geographically locating you relative to other users on QURLI.
  • Security and access control: Location data, including geographical position, time identifier, usage data, activity data, account data and others are used for monitoring, analyzing, and testing of networks and IT infrastructures, system and error checks, documentation, security copies, and communication of security updates;
  • Fraud, platform abuse, child safety, and unlawful-content detection: Mandatory and optional data collected in the process of creating your QURLI account (see Article 2), transactional data, texts and pictures shared in chat conversations (see Article 2), pictures or videos that you upload, publish, or otherwise provide (see Article 2), information about images (e.g. metadata), such as approximate photo location and device information (see Article 2), and other relevant usage data, may be used to detect, analyse, investigate, and prevent fraudulent activities, scams, exploitation, CSAM, and other violations of applicable law, our Terms and Conditions, and other applicable QURLI policies. We rely on a combination of automated systems and manual reviews to achieve this. This may include the use of specialised trust and safety or child-safety service providers who process the content itself and/or derived data such as hashes, results, scores, or related technical indicators on our behalf. Certain limited provider-side processing of derived data may also occur where permitted by applicable law and appropriate contractual safeguards.   • Age verification and minor protection: We may process verification outcomes, limited related information made available in connection with the verification, and, where applicable, review or appeal materials, to verify whether users satisfy our minimum age requirements, to prevent minors from accessing QURLI, and to determine whether a user may access or continue using QURLI or be subject to account restrictions or enforcement action under our Terms and Conditions and applicable guidelines.
  • Market and opinion research, analytics: We use usage data, activity data, insights, responses, testimonials, interactions, and others to monitor and analyze your use of QURLI. We may also use this data, along with other personal data you provide, such as age, height, gender, and others, for internal research and analytics, further developing the offers on QURLI, administering focus groups, determining user demographics, conducting market studies and surveys, and analyzing user behavior to enhance the overall experience on QURLI.
  • For the purpose of Advertising and marketing, including promotional offers, events, and contests, we mainly utilize your insights and information used for participation in different contests, events, and promotions we provide. With your consent, we use your email to send updates about QURLI, including but not limited to events, features and promotions. You can unsubscribe at any time via the link in our emails or in-app settings;
  • Compliance with laws and regulatory recommendations and directives: Know your customer (KYC) clarifications, fulfillment of disclosure, information and reporting obligations, fulfillment of archiving and record-keeping obligation, responding to law enforcement or regulatory requests, and the prevention, detection, investigation, and clarification of unlawful or criminal acts. This may also include processing necessary to comply with child-safety, unlawful-content, online-safety, reporting, archiving, and related regulatory obligations applicable to QURLI in certain jurisdictions.
  • To facilitate matching and messaging we may make your profile and associated content (such as your profile photos, profile details and the information in your ad) visible to other users of our service, including users who access it through other applications owned and operated by us, for the same purposes for which you joined. This functionality introduces no additional or third-party controller in respect of your Personal Data, and no Personal Data is transferred to any separate company or other controller in connection with it. Any service providers we engage are dealt with as described in Article 9 of this Policy.
  • Safeguarding legal claims: Assertion, enforcement, and defense of legal claims, and
  • Other: For any other purpose with your consent.

a. Safety features and limited data sharing

When you upload or post content to QURLI, including your profile photos, please keep in mind that, in certain limited circumstances, some of this information may become viewable outside the app if you or your chat partner use certain safety features. We encourage users to think carefully about what they share and to avoid posting content they would not feel comfortable being seen by others.

Some optional safety features, such as Safety Signal, may allow limited information that you or another user have made visible on QURLI to be shared with a trusted contact outside the app. This visibility for the trusted contact occurs strictly for personal safety reasons, lasts only for a limited duration, and is protected by a password-locked link that expires automatically when the session ends or the user deactivates the feature.

By using QURLI, you acknowledge that:

  • You should be careful about what you post or share on QURLI, as profile images you choose to make public on your profile may, in limited cases, be viewable outside the app by non-users when certain features are used.
  • If you or your chat partner activate the Safety Signal feature, the trusted contact of the person who activates the feature may see the public profile photos of that person’s chat partner. 
  • If you activate the Safety Signal feature yourself, only your own location data will be shared with your selected trusted contact for the duration you choose. When meeting a chat partner in person, it may be possible for that person’s approximate location to be inferred from yours, even though their location is not directly shared through the feature.
  • To ensure transparency, when the Safety Signal feature is activated, the chat partner is notified that the feature is in use. 
  • After a Safety Signal session ends, we may send the user who activated it a post-date check-in, and we collect and store the user’s responses as part of Safety Signal-related data for safety, reporting, and moderation purposes.

Make sure that notifications are enabled on your device to ensure that you receive Safety Signal alerts and notifications. QURLI does not otherwise publish or disclose private user data to non-users, and any such visibility remains strictly time-limited and password-protected. 6. Online tracking and analysis

a. Analytics

We use analytics and research technologies on QURLI to collect information about how visitors use QURLI. 

b. Log files

When using QURLI, general access data is stored in a log file for the creation of statistics. We use this data for statistical and technical evaluations in anonymized form, for example to optimize the server infrastructure, to determine on which days there are particularly many accesses, or to draw conclusions about possible improvements to the user interface and functionalities. A personal evaluation of this data does not take place.

7. Data Transfers to Third Countries

We may transfer your Personal Data abroad to our business partners located in third countries, specializing in Analytics, Data Processing, Business Operations and Data Integration, Content Moderation, Marketing, and App Tracking.

To safeguard your data privacy rights when transferring your personal data to third countries, including those where adequate data protection might not be guaranteed, we use tools such as Standard Contractual Clauses (SCCs) - approved by the European Commission and other relevant data protection authorities, Binding Corporate Rules (BCR), and other appropriate mechanisms that ensure the personal data transfer complies with applicable laws and regulations. These mechanisms are designed to provide a legal framework for the protection of your personal data during international transfers and demonstrate our commitment to maintaining the highest standards of data protection.

In addition, we ensure that the personal data transfer complies with applicable law, aiming to give your personal data the same level of protection as it has in Switzerland and in the European Union. We carefully assess whether the transfer is based on an adequacy decision, which, as a point of clarification, is an official determination by the European Commission (as applicable) regarding the adequacy of data protection in the third country. Such a determination can simplify data transfers to certain countries. Furthermore, we take into consideration specific safeguards outlined in GDPR Article 46, including Binding Corporate Rules (BCR) and Standard Contractual Clauses (SCCs).

When required, we may rely on your explicit consent for data transfers, as stipulated by the provisions Swiss privacy data regulations, GDPR and other applicable regulations. We conduct a comprehensive assessment to safeguard your personal data when transferred to third countries. This reflects our unwavering commitment to protect your data during international transfers and mitigate potential privacy risks. We take your privacy seriously and ensure that such transfers comply with the requirements of these data protection laws and regulations.

8. Safety and Transparency when sharing User’s Personal Data with Third Parties

In alignment with applicable data protection regulations, we prioritize transparency when it comes to the transfer of your personal data to third parties. This section provides you with essential details regarding such transfers. We may transfer your personal data to carefully selected third parties situated within or outside the jurisdiction in which you reside when we have a business reason to engage these organizations.

Once again, we would like to emphasize that we consistently ensure compliance with legal requirements by using up-to-date necessary and recognised mechanisms, guaranteeing the confidentiality and integrity of your personal data's privacy and security throughout its processing and transmission to these third parties.

As we operate on a global scale, the recipient of shared Personal Data and the location data of processing may vary depending on your geographical location and other events. Third parties are located and may process shared data in countries within the European Economic Area (EEA) and the European Union (EU) (including but not limited to Ireland, Belgium, Netherlands, Denmark, France, Germany, Cyprus, and Finland). Additionally, data may be shared to other countries in Europe (including but not limited to the United Kingdom and Russia), as well as to Asia (including but not limited to Israel, India, Vietnam, Japan, Singapore and Hong Kong). Furthermore, data processing and sharing extends to third parties in North and South America (including but not limited to the United States of America, Canada, Mexico, and Brazil) and Australia.

9. What Personal Data do we share with third parties?

In particular, we may disclose your Personal Data to the following categories of recipients:

  • Service providers: We work with trusted service providers that process your Personal Data on our behalf or under joint responsibility (e.g., providers of telecommunications systems, email, database, hosting, customer-communication tools, outsourcing, payment, user verification, advertising, marketing, analytics, anti-spam service, security, fraud prevention, and trust and safety moderation). These service providers may also use your Personal Data for their own purposes. Service providers provide information about their independent data processing in their own privacy statements.
  • Buyers or merger partners: In connection with an actual or potential restructuring of part or all of our business or our assets or any rights or interests therein, we may disclose your Personal Data to potential buyers or merger partners or sellers and their advisors.
  • Government agencies and legal representatives: We may disclose your Personal Data to governmental agencies, courts, law enforcement and other authorities, both domestic and foreign, and legal representatives, if we are legally obligated or entitled to do so or if we deem it necessary to do so in order to protect our interests. This includes situations where disclosure would protect QURLI’s, Users', business partners', or other relevant parties' legal rights, to assist in the detection or prevention of crime, mitigate our liability in an actual or threatened lawsuit, enable us to enforce our agreements with you and accurately address, prevent, or respond to illegal activity, suspected fraud, or other misconduct.

We require all third parties to respect the security of your Personal Data and to treat it in accordance with the law. We do not allow our third-party service providers to use your Personal Data for their own purposes and only permit them to process your Personal Data for specified purposes and in accordance with our instructions.

This disclosure aligns with our commitment to transparency, in accordance with relevant data protection laws and regulations. Please refer to the Articles 7 and 8 of this Privacy Policy for detailed information on data sharing and protection practices.

10. What Personal Data do we receive from third parties?

By signing in to QURLI using your Facebook account you give permission to Facebook to share your email address, name and your profile picture with QURLI. You have an option to manually opt-out of permission to allow Facebook sharing your email address with QURLI, however this is only possible when an email is associated with your Facebook account.

By signing in QURLI with your Google Account you give permission to Google to share your name, email address, language preference and with QURLI.

Compiled data will be used in order to form your account on QURLI. You can always manually withdraw your permission to access the data above by removing the QURLI app from the Facebook settings or from your Google account. Data provided at the set up of the account using any of these third party services will still be accessible to QURLI, even after you withdraw permission on these third party services. In order to remove our access to this data you will have to delete your QURLI account. 11. How long do we retain your Personal Data?

We only retain your Personal Data for as long as it is needed for the purpose for which it was originally collected or as we are required to retain it under applicable laws, regulations and contractual agreements. Certain data will be retained up to 180 days post-deletion to ensure compliance with above-mentioned purposes. This also helps us maintain a secure environment and strengthens our ability to prevent potential risks, frauds, undesirable activities and to safeguard crucial information, which is vital for our legitimate interest in ensuring the platform’s integrity, along with well-being and safety of our users. Furthermore, this allows us to comply with our legal obligations, which may be necessary for establishing, exercising, or defending legal claims, as well as preventing ongoing violations by users

We may periodically delete inactive accounts and related data as described in our Terms and Conditions (here). Accounts that remain unused for 730 days without an active purchased subscription or unused in-app purchases may be scheduled for deletion. Users will receive a notification email in advance and may prevent deletion by logging in within the indicated period. After that, the account and associated data will be permanently deleted, except for limited information that QURLI must retain for compliance, accounting, or legitimate business purposes

12. AI features

a. AI bio generation

Users may access an AI-powered ad generation feature (hereinafter, “AI bio generation”) designed to assist in creating personal ads in text form on QURLI. When you choose to use this feature, we process and share limited profile data, which may include your gender, sexual orientation, age, height, language preferences, and any text or voice input you voluntarily provide, with our third-party AI service provider solely for the purpose of generating textual ad suggestions.

To protect User privacy, all shared data is pseudonymised before sharing and processed under strict contractual, confidentiality, and data protection safeguards, in alignment with the safety mechanisms described in this Privacy Policy. The data is not linked to your account identifiers and none of your account identifiers are shared with the third-party AI service providers. AI bio generation involves automated text processing to create suggested ad content, however, the final decision on what to post remains entirely with you. 

If you no longer wish for QURLI to share your data with the AI service provider for this feature, you may withdraw your consent at any time by emailing us at [email protected]. Once your opt-out request is processed, no further data related to this feature will be shared.

13. How do we secure your Personal Data?

We use appropriate technical and organizational security measures to protect Personal Data from loss, misuse, or alteration. Our employees and the service providers commissioned by us are contractually obliged to maintain confidentiality and to comply with the provisions of data protection law.

However, it is not possible for us to guarantee the absolute security of Personal Data. In this context, please note that data transmitted over an open network such as the Internet or an email service is openly accessible. We cannot guarantee the confidentiality of messages or content shared over these networks. Thus, Personal Data sent to us via open networks will not be subject to the same security measures as Personal Data contained within QURLI.

14. Your rights

You have the following rights:

  • Access: You have the right to access your Personal Data. This gives you the opportunity to check what Personal Data we process about you and that we process it in accordance with the applicable data protection regulations.

15. Children's privacy

Users who are not at least 18 years old, or older when explicitly required by applicable state laws, (referred to as “minor/s” hereafter) are not permitted to use QURLI. We do not knowingly collect Personal Data from minors.

We encourage parents and legal guardians to monitor their children's Internet usage and to help enforce our Privacy Policy by instructing their children not to use QURLI and thus not to provide Personal Data on QURLI. If you have reason to believe that a minor has provided Personal Data to us, please contact us immediately and we will endeavor to delete that data from our databases.

16. Changes to this Privacy Policy

We reserve the right to modify, add to, change, or remove parts of this Privacy Policy at any time at our own discretion (“Modifications”). This also applies to related documents that are directly linked to this Privacy Policy.
